SLOPE SOFTWARE, INC. PRIVACY POLICY

This statement sets forth the Privacy Policy (the “Privacy Policy”) of Slope Software, Inc. (the “Company”, “us”, “we” or “our”) for the use of this website (the “Website” or “Site”) operated by the Company. We respect your privacy and are committed to protecting personally identifiable information you may provide us through our Website, and we’ve adopted this Privacy Policy to explain what information may be collected on our Website, how we use this
information, and under what circumstances we may disclose the information to third parties. This Privacy Policy applies only to information we collect through our Website and does not apply to our collection of information from other sources.

From time to time, we may change this Privacy Policy in our sole discretion.  For example, as we update and improve our service, new features may require modifications to the Privacy Policy.  Accordingly, you should note the date of the latest revision of this Privacy Policy posted at the top of this Privacy Policy, which should alert you to changes in this Privacy Policy since your prior visit to this Website.  When you access our website, you agree to this Privacy Policy.  If you do not agree to this Privacy Policy, or to any changes we may subsequently make, immediately stop accessing our Website.

INFORMATION WE COLLECT

Our Website collects two kinds of information about you: (a) information provided by you that personally identifies you; and (b) information that the Website collects automatically related to your interests, behavior and actions when visiting our Website.

(1) Personally Identifiable Information: Our definition of personally identifiable information includes any information that may be used to specifically identify or contact you, including but not limited to your name, shipping address, billing address, phone number, company name and email address.  As a policy, we do not automatically collect your personally identifiable information when you visit our Website. In certain circumstances, we may request this type of information when required to participate in the particular activity, realize a benefit we may offer, or gain access to certain content on our Website.

(2) Non-Personally Identifiable Information: Our definition of non-personally identifiable information is any information that does not personally identify you.  Non-personally identifiable information can include certain personally identifiable information that has been de-identified; that is, information that has been rendered anonymous.  We obtain non-personally identifiable information about you from information that you provide us, either separately or together with your personally identifiable information. We also automatically collect certain non-personally identifiable information from you when you access our Website.  This information can include, among other things, the type of browser you are using (e.g., Google Chrome, Internet Explorer, Safari, etc.), the third party website from which your visit originated, the operating system you are using (e.g., Vista, Windows XP, Mac OS, etc.), the domain name of your Internet service provider (e.g., AT&T, America Online, NetZero, etc.), the search terms you used to find our Website, the specific web pages you visit, and the duration of your visits.

HOW WE USE AND SHARE THE INFORMATION COLLECTED

(1) Personally Identifiable Information: The personally identifiable information you submit to us is used to carry out your requests, respond to your inquiries, better serve you, or in other ways naturally associated with the circumstances in which you provided the information.  We may also use this information to later contact you for a variety of reasons, including for customer service purposes and/or to provide you promotional information for our products. We may use third parties to carry out the foregoing and other business functions and, in such instances, these third parties may use your information for these limited purposes on our behalf.  In some instances, we may also share your personally identifiable information with our vendors with whom we have marketing relationships.

(2) Non-Personally Identifiable Information: We use non-personally identifiable information in a variety of ways, including to help analyze Website traffic, understand customer needs and trends, carry out targeted promotional activities, and to improve our services.  We may use your non-personally identifiable information by itself or aggregate it with information we have obtained from you, and we may share your non-personally identifiable information with third parties to achieve these objectives and others.  

COOKIES AND PREFERENCE-BASED ADVERTISING

(1) Cookies and Web Beacons: We automatically receive and store certain types of non-personally identifiable information whenever you interact with us.  For example, like many websites, we use “cookies” and “web beacons” (also called “clear gifs” or “pixel tags”) to obtain certain types of information when your web browser accesses our Website.  “Cookies” are small files that we transfer to your computer’s hard drive or your Web browser memory to enable our systems to recognize your browser and to provide convenience and other features to you, such as recognizing you as a frequent user of our Website.  “Web beacons” are tiny graphics with a unique identifier, similar in function to cookies, and may be used to track the online movements of users, when an email has been opened, and to provide other information.

Examples of the information we collect and analyze in this manner include the Internet protocol (IP) address used to connect your computer to the Internet; computer and connection information such as browser type and version, operating system, and platform; your behavior on our Website, including the URL you enter from as well as the URL you go to next (whether this URL is on our Website or not); and cookie number.  It is important to note that the cookies and Web beacons that we use do not themselves contain any of your personally identifiable information.

If you are concerned about the storage and use of cookies, you may be able to direct your internet browser to notify you and seek approval whenever a cookie is being sent to your Web browser or hard drive.  You may also delete a cookie manually from your hard drive through your internet browser or other programs.

(2) Preference Based Advertising: We may now or in the future work with third parties, including third party advertising networks and website analysis firms, who use cookies and web beacons to collect non-personally identifiable information when you visit our Website and third party sites.  This non-personally identifiable information, collected through cookies and web beacons, is often used by these advertising networks to serve you with advertisements, while on third party sites, tailored to meet your preferences and needs.

OTHER USES OF COLLECTED INFORMATION

(1) IP Addresses: An IP address is a number that is automatically assigned to your computer whenever you are surfing the Internet.  Web servers (computers that “serve up” web pages) automatically identify your computer by its IP address. When visitors request pages from our Website, our servers typically log their IP addresses.  We collect IP addresses for purposes of system administration, to report non-personal aggregate information to others, and to track the use of our Website. IP addresses are considered non-personally identifiable information and may also be shared as provided above.  

(2) Email Communications: If you send us an email with questions or comments, we may use your personally identifiable information to respond to your questions or comments, and we may save your questions or comments for future reference.  For security reasons, we do not recommend that you send to us by email any non-public personal information, such as passwords, social security numbers, bank account information or any proprietary information.

(3) Transfer of Assets: As we continue to develop our business, we may sell or purchase assets.  If another entity acquires us or all (or substantially all) of our assets, the personally identifiable information and non-personally identifiable information we have about you will be transferred to and used by this acquiring entity.  Also, if any bankruptcy or reorganization proceeding is brought by or against us, all such information may be considered an asset of ours and as such may be sold or transferred to third parties.

(4) Other: Notwithstanding anything herein to the contrary, we reserve the right to disclose any personally identifiable or non-personally identifiable information about you if we are required to do so by law, with respect to copyright and other intellectual property infringement claims, or if we believe that such action is necessary to: (a) fulfill a government request; (b) conform with the requirements of the law or legal process; (c) protect or defend our legal rights or property, our Website, or other users; or (d) in an emergency to protect the health and safety of our Website’s users or the general public.

CHILDREN’S PRIVACY AND WEBSITE AGE LIMITATIONS

This Website is intended for use by persons aged 18 or older, and by your use of this Website you affirm that you are at least 18 years of age.  We do not knowingly collect personally identifiable information from children under the age of 18. If you are a parent or guardian of a child under the age of 18 and believe he or she has disclosed personally identifiable information to us please contact as provided below.  In any such event, a parent or guardian of a child under the age of 18 may review and request deletion of such child’s personally identifiable information as well as prohibit the use thereof.

KEEPING YOUR INFORMATION SECURE

We have implemented security measures we consider reasonable and appropriate to protect against the loss, misuse and alteration of the information under our control.  Please be advised, however, that while we strive to protect your personally identifiable information and privacy, we cannot guarantee or warrant the security of any information you disclose or transmit to us online and are not responsible for the theft, destruction, or inadvertent disclosure of your personally identifiable information.  In the event that your personally identifiable information (as the term or similar terms are defined by applicable law requiring notice upon a security breach) is compromised or we believe that it may have been compromised, we may use email as the means to notify you (at our sole discretion), and in such event email will be sent to the last email address you have provided to us.

THIRD PARTY SITES/LINKS

In an attempt to provide increased value to our customers and other Website visitors, our Website may link to, or contain links for, third party websites that we do not control or maintain.  These may include websites linked to products referenced on our Website or in advertisements on the Website. We are not responsible for the terms and conditions or privacy practices employed by any third party website accessible from our Website.  These linked sites are only for your convenience and therefore you access them at your own risk, and we encourage you to read the privacy statements of all third party websites before submitting any personally identifiable information while using such other websites.  

OPT-OUT INFORMATION

You may contact us by mail or email at the notice addresses posted below if: (a) you have questions or comments about our Privacy Policy; (b) wish to make corrections to any personally identifiable information you have provided us; (c) want to opt-out from receiving future commercial correspondence from us; or (d) wish to withdraw your consent to our sharing of your personally identifiable information with companies with whom we have marketing relationships.  

We will respond to your request and, if applicable and appropriate, make the requested change in our active databases as soon as reasonably practicable.  Please note that we may not be able to fulfill certain requests while allowing you access to certain benefits and features of our Website.

GOVERNING LAW

This Privacy Policy and any dispute arising hereunder, shall be governed by the laws of the State of the Georgia, without giving effect to such state’s choice of law or conflict of laws provisions.

ADDITIONAL NOTICES TO CALIFORNIA RESIDENTS

(1) Do-Not Track Disclosure: At this time, our Services are not set up to honor web browser do-not-track settings.

(2) Information on Marketing Disclosures: California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. (3) Content Removal Requests for Users Under 18 Years Old: If you are a user under 18 years of age and reside in California, you may request and obtain removal of, content or information that you have posted on the Services. We will review the request and respond promptly. You should be aware that a request to remove content or information posted by you on the Services does not ensure or require complete or comprehensive removal of such content or information from our databases.

ADDITIONAL NOTICES TO EUROPEAN RESIDENTS OR OTHER DATA SUBJECTS UNDER THE GENERAL DATA PROTECTION REGULATION (THE “GDPR”)

(1) Legal Bases for Processing Your Personal Information

When processing your personal information, we may rely on one or more of the following legal bases (or other available grounds), depending on the circumstances:

  • Legitimate Interests – We may process your personal information where we have a legitimate interest in such processing for managing, operating, or promoting our business, and that legitimate interest is not overridden by your interests, fundamental rights, or freedoms.
  • Specific Consent – We may process your personal information where we have obtained your specific, affirmative consent prior to the processing.
  • Performance of a Contract – We may process your personal information where such processing is necessary in connection with any contract that we have with you.

(2) Security of Your Personal Information: We have policies and technical and organizational measures in place which are intended to safeguard and protect your personal information against unauthorized access, accidental loss, improper use and disclosure. However, you should be aware that information transmitted over the internet is not completely secure because of the nature of the internet and that systems and measures used to secure information are not flawless. For these reasons, although we will use reasonable efforts to protect your personal information, we do not warrant the security of personal information transmitted to us or stored by us, and personal information that is transmitted to us by you electronically is done at your own risk.

(3) Retention of Your Information: We keep your information for as long as is reasonably necessary to accomplish the purposes for which we collected such personal information, including for the purposes of satisfying any professional, legal, accounting or reporting requirements to which we are subject.  To determine the appropriate retention period for personal information, we consider the scope, nature, and sensitivity of the personal information, the potential risk of harm from unauthorized use or disclosure of the personal information, the purposes for which we collected and processed your information and whether we can achieve those purposes through other means, and any applicable legal and professional requirements.  We review our retention periods on a regular basis.

(4) Electronic Communications: We will only send you marketing communications if you have explicitly provided your prior affirmative consent. If you have previously provided your affirmative consent, you may opt out of our marketing communications at any time by clicking the unsubscribe link at the end of our marketing communications.

(5) Your Rights as a European Union Resident or Other Data Subject

Under the GDPR, you have certain rights concerning the personal information that we hold about you, including the following:

  • Right of Access – You have a right to be informed about what personal information we hold about you and to request a copy of this personal information, which we will provide you with unless legal exceptions apply.

  • Right to Withdraw Consent – Where processing of your personal information is based on your consent, you have the right to withdraw such consent at any time.
  • Right to Object – Where we rely on our legitimate interests to process your personal information, you have the right to object to such use and we are required to discontinue such processing unless we can demonstrate an overriding legitimate interest in such processing.
  • Right to Restriction – You have the right to request that we stop using your personal information in certain circumstances including if you believe that the personal information we hold about you is inaccurate or that we are not lawfully allowed to use such personal information. If you validly exercise this right, we will store your personal information and will not carry out any other processing until the dispute is resolved.
